PayrollOrg Supports USCIS E-Verify NextGen Project

PayrollOrg commented in support of the U.S. Citizenship and Immigration Services’ (USCIS) proposed new E-Verify NextGen service. PAYO agreed with USCIS that NextGen could be an exciting new program that greatly enhances the employment eligibility verification process.

With NextGen, employees will enter their own information, so the potential for employer errors would be greatly reduced. In addition, USCIS plans to directly communicate with employees about Further Action Notices (FANs) through NextGen, which will speed up the onboarding process. The FAN indicates a mismatch or other error in an employee’s information.

 

NextGen Process

According to USCIS, new hires will enter their information directly into NextGen. Employees must also provide identity documents on their secure USCIS internet-based myE-Verify account. The system will confirm the details and notify the employer.

The employer must then follow the rules for document review and enter the information in the NextGen system. An employer can follow the new alternative verification method for remote documents. NextGen will create a Form I-9, Employment Eligibility Verification, for the employer to download and retain.

Another useful feature of NextGen is employees may reuse their information with their next employer. Generally, they will not be required to complete another Form I-9. Instead, their data will be saved in their myE-Verify account.

USCIS plans to phase in the NextGen system in 2024. Initially, employers will not be required to use NextGen.
