Massachusetts Pay Data Reporting Requirements in 2025

Effective February 1, 2025, certain employers in Massachusetts will be required to submit pay data reports to the Secretary of State [H.B. 4890, L. 2024].

Employers will be required to submit a pay data report if they have 100 or more employees in Massachusetts for the entire prior calendar year and are subject to federal filing requirements of a wage data report. The pay data report will be a copy of the employer’s federal EEO-1 data report for the prior year. The reporting will be required annually.

Employers that submit EEO-3 or EEO-5 data reports (covering local unions and elementary and secondary schools, respectively) will be required to submit pay data reports to the state every other year, in odd-numbered years. The first report will be due February 1, 2025.

For employers that submit EEO-4 reports (covering state and local governments), copies will be submitted to the state every other year, in even-numbered years, beginning February 1, 2026.
